Terms of Service TERMS OF SERVICE
Last Updated April 24, 2008 Terms. Rustic Falls, LLC doing business as R.F. Engraving (“R.F. Engraving” or “we”) operates RFEngraving.com. The products and services offered by R.F. Engraving are governed by these Terms of Service. By accessing RFEngraving.com or ordering products or services from R.F. Engraving, you are agreeing to be bound by these Terms of Service. If you do not agree to be bound by these Terms of Service, you should not order products and services from R.F. Engraving. Changes/Updates. R.F. Engraving may modify these Terms of Service from time to time and such modification shall be effective upon posting on RFEngraving.com. Your continued use of RFEngraving.com after revised Terms of Service are posted signifies your acceptance of the revised Terms of Service. It is therefore important that you review these Terms of Service regularly to ensure you are updated as to any changes. Right to Refuse Service. R.F. Engraving reserves the right, in its sole discretion, to reject or refuse to conduct business with you or to deny, restrict, or terminate your access to RFEngraving.com at any time, for any or no reason, with or without prior notice or explanation, and without liability. R.F. Engraving expressly reserves the right to remove your profile and/or deny, restrict, or terminate your access to all or any part of RFEngraving.com if we determine, in its sole discretion, that you have violated these Terms of Service. Password. When you sign up to purchase products and services from RFEngraving.com, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree to notify R.F. Engraving immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account. Copyrights and Other Intellectual Property. R.F. Engraving respects the intellectual property of others, and requires that our Customers do the same. However, R.F. Engraving does not check for or obtain copyright permission on material (artwork, sayings, pictures, etc.) submitted by the User. Customers must either use material, which does not have a copyright, or have permission from the copyright owner. R.F. Engraving reserves the right to refuse a request for products or services, which may violate a copyright of another. Under no circumstance will R.F. Engraving be liable for the infringement of another’s copyright. All liability shall remain with the User. By receiving products or services from R.F. Engraving, the User agrees to indemnify R.F. Engraving from any and all liability resulting from the infringement of another’s copyright or other intellectual property. If you believe your work has been copied and posted on or through RFEngraving.com in a way that constitutes copyright infringement, please send the R.F. Engraving Copyright Agent a notification of claimed infringement with all of the following information: (a) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (b) identification of the claimed infringing material and information reasonably sufficient to permit us to locate the material on rusticfalls.com (providing the URL(s) of the claimed infringing material satisfies this requirement); (c) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (e) a statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and (f) your physical or electronic signature. R.F. Engraving's Copyright Agent for notification of claimed infringement can be reached as follows: Copyright Agent, R.F. Engraving, P.O. Box 1102, Grantsville, UT 84029. Variation in Materials. Due to the nature of the materials used (wood, marble, etc.), many products will have slight variations from one another. For example, wood grain, marks on the wood, coloring of the tiles, etc. These variations are the natural result of using organic materials. Displaying Products. R.F. Engraving may display completed products for marketing purposes. This may be done by using a photograph of the product and displaying it on the website, in marketing materials, etc. Or, the final engraved product may be reproduced to display or show as samples, etc. Return and Refunds. R.F. Engraving is dedicated to customer satisfaction. If there are any defects with the product you order (Example: a clock does not function), you can return that defective item within 90-days of purchase for an exchange or full refund. Because of the custom nature of engraving, products cannot be returned for reasons other than defects. Please contact R.F. Engraving for instruction on returning the defective item. The following conditions apply to returns and refunds of defective products: 1. Customers are responsible for shipping costs to and from R.F. Engraving. These costs vary according to weight, size, shipping type, and location. 2. Products that are damaged after they are received by the customer (Example: water spilled on product, item is damaged by dropping, etc.) are not eligible for return or refund. 3. R.F. Engraving reserves the right to refuse a return or refund if it suspects that the product was damaged after being received by the Customer or through misuse by the Customer. |
